شرط داوری :
کلیه اختلافات و دعاوی ناشی از این قرارداد و یا مرتبط با آن از جمله انعقاد، اعتبار، فسخ، نقض، تفسیر یا اجرای آن به مرکز داوری اتاق ایران ارجاع می گردد که مطابق با قواعد داوری مرکز داوری اتاق ایران به صورت قطعی و لازم الاجرا حل و فصل گردد. این شرط داوری، موافقتنامه ای مستقل از قرارداد اصلی تلقی می شود و در هر حال لازم الاجراست.
Dispute Settlement: All disputes and claims arising from or relating including its conclusion, validity, termination or to the present contract breach, and its interpretation or application shall be submitted to the Arbitration Center of the Iran Chamber (ACIC) for binding and final arbitration by one or three arbitrators in accordance with the Law of Statute of the Arbitration Center of Iran Chamber and Arbitration of ACIC. In addition to the applicable laws and regulations, the Rules arbitrator(s) shall take into account the relevant trade usages. The present as an agreement independent of this be treated arbitration clause shall contract and shall in any case be binding
شرط میانجیگری همراه با شرط داوری :
کلیه اختلافات و دعاوی ناشی از این قرارداد یا راجع به آن ابتدا از طریق میانجیگری مطابق قواعد میانجیگری مرکز داوری اتاق بازرگانی، صنایع، معادن و کشاورزی ایران حل و فصل خواهد شد. مدت میانجیگری از تاریخ شروع، دو ماه است و با تراضی قابل تمدید میباشد.
طرفین ضمن همین توافق و به عنوان موافقتنامه مستقل از قرارداد اصلی، تراضی و توافق نمودند که اختلافات و دعاوی ناشی از قرارداد یا راجع به با آن از جمله انعقاد، اعتبار، فسخ، نقض، تفسیر یا اجرای قرارداد که ظرف مدت مقرر از طریق میانجیگری حل و فصل نشود، نهایتا به داوری توسط مرکز داوری اتاق بازرگانی ایران ارجاع و مطابق قواعد و آئین داوری همان مرکز حل و فصل میشود. رای داوری قطعی و لازم الاجرا میباشد.
All disputes and claims arising out of or relating to the present contract shall be submitted to ACIC mediation in accordance with Mediation Rules of ACIC. The mediation process shall be completed within two months as of the date of the commencement of the proceeding. This time limit may be extended by mutual consent of the parties.
The parties agreed by terms of this contract and as an independent agreement from the main contract that any disputes and claims arising out from or relating to the present contract Including its conclusion, validity, termination or breach and its interpretation or application which is not settled through mediation within the said time limit, shall be finally submitted to ACIC arbitration and shall be resolved in accordance with the Rules of Arbitration of the ACIC. The arbitration award shall be final and enforceable
شرط میانجیگری بدون شرط داوری :
کلیه اختلافات و دعاوی ناشی از این قرارداد یا مرتبط با آن از طریق میانجیگری توسط مرکز داوری اتاق بازرگانی، صنایع، معادن و کشاورزی ایران و مطابق قواعد میانجیگری آن مرکز حل و فصل خواهد شد. مدت میانجیگری از تاریخ شروع، دو ماه است و با تراضی قابل تمدید میباشد.
